Bill could help short sale sellers in 2013

WASHINGTON – April 2, 2012 – Under U.S. law, a homeowner with an underwater mortgage who goes through a short sale has part of his or her debt forgiven by a bank. The amount forgiven is legally considered income, as if the lender gave the owner a monetary gift by saying, “You no longer have to pay this.”

As a gift, that money is income and taxable by the IRS when the homeowner fills out his yearly income taxes. However, a temporary law effective through Dec. 31, 2012, nixes that amount as homeowner income, making the debt forgiveness tax-free. A short sale in 2012, then, allows a homeowner to walk away free of debt.

As it stands now, that rule expires next year, and underwater homeowners who go through a short sale could be taxed on the amount forgiven.

However, a bipartisan bill introduced late last week by U.S. Senators Debbie Stabenow (D-MI) and Dean Heller (R-NV) – the Mortgage Relief Act – would extend that rule past Dec. 31 if approved by both the House and Senate and signed by President Obama. Senators Robert Menendez (D-NJ), Sherrod Brown (D-OH) and Jeff Merkley (D-OR) cosponsored the legislation.

“It is bad enough that so many families are faced with mortgages that now exceed the value of their home,” says Stabenow. “But to add insult to injury, without this bill, the IRS would once again require these families to pay hundreds or thousands of dollars in additional income tax when they sell or refinance their home. That’s just wrong.”

Stabenow championed the original Mortgage Relief Act of 2007 designed to fix the problem that now expires at the end of 2012. Stabenow and Heller’s new bill will extend this tax protection for underwater homeowners through 2015.

Approximately, 20 to 25 percent of American homeowners are currently underwater on their mortgages.

Big Plans for Sandestin

Sandestin, FL – There are some major events on the horizon for Sandestin Golf and Beach Resort.

Sandestin owner Tom Becnel said recently in a Northwest Florida Daily News article that he has two major new developments in the design phase, as well as several new additions to the resort this year.

Becnel is in the planning stages of a 96-unit condominium and a 36-home subdivision.

The condo project is slated for the Osprey Point property between the Heron Walk and Baypine Cottages communities in the Lakeside area of Sandestin. Becnel plans to market the units in the spring and if sales are strong, he will start construction this fall.

The new subdivision will be built across from the Burnt Pine Golf Club on a parcel of undeveloped land. Becnel couldn’t say when construction on that project would begin. But he did say that the is focusing on buyers, who are looking to stay in Sandestin for the long haul and not speculators.

Another project Becnel has been been working on is the $2-million renovation of the Bayside Inn that should wrap up at the end of March. The Inn will be rebranded with a new logo, furniture in all condos and a new pool deck, Becnel said.

The marina at Baytowne is also looking to get upgraded. Becnel applied for permits from the Army Corps of Engineers for a new pier and boat dock for 50 to 70 boats 100 feet or longer. The marina will also get a floating water park and will continue to rent YOLO boards this summer.

The Village of Baytowne Wharf will get two new tenants, Becnel said. The Hofbrau Beer Garden is scheduled to open by Spring Break. And a new Ben and Jerry’s ice cream shop will open in the next few months.

WASHINGTON – March 13, 2012 – Pricing a home realistically gets potential buyers through the door, but how do you get them to fall in love with a home? An article at U.S. News & World Report offers the following tips for sellers.

• Add curb appeal: “Make sure the house is cleared of winter clutter, that windows are washed, that the front door is painted or clean,” says Brad Knapp, regional vice president for the National Association of Realtors® for Ohio and Michigan. “You have to give the house good curb appeal.”

• Declutter: Remove clutter from the home so that buyers can actually see everything the home has to offer. Any excess belongings of the sellers should be stored in the garage or in a storage unit.

• Be careful not to offend: “Hunters and fisherman often have game hanging on the walls,” Knapp notes. “Some people are offended, so get that off the walls and into the garage.”

• Consider staging: “It might behoove (sellers) to hire a professional stager to help them,” says Robert Simon, a professor at Cleveland State University. “You have to get it right so it looks lived in – but definitely not cluttered.”

• Complete routine maintenance: Make sure sellers complete obvious maintenance projects before the home is listed. Also, sellers need to realize that “people don’t care if you spent $15,000 fixing the roof. It’s worth nothing,” Simon says. “The market expects the roof to be in tip-top shape. You have to go above and beyond.”
